A Senate-approved bill (SB 3) that would have legalized cannabis in the state went on what seemed to be a roller coaster ride, which unfortunately ended in a downturn. The bill was first defeated by the House State Affairs Committee, was then revived by a legislative process known as a smoke-out, to end up in the House for consideration, where it was ultimately killed by lawmakers. The New York State Office of Cannabis Management (OCM) sent letters ordering dozens of businesses suspected of illegally selling cannabis, including the practice of “gifting,” which is the exchange of goods for memberships, subscriptions, or other goods, to cease and desist those operations or risk the opportunity to get a license in the legal market as well as substantial fines and possible criminal penalties. The letters explain that while cannabis has been legalized for those aged 21 and over, selling it requires a license under the law.

South Dakota Gov. Noem wants activists to pay for the legal bills stemming from her lawsuit for stopping the citizen-voted cannabis legalization. Taxpayers are currently on the hook for at least $142,000 in legal fees that the administration paid, according to The Argus Leader. A recent poll found that most South Dakota voters approve of Noem’s job performance overall, just 39 percent approve of her handling of marijuana legalization, with 51 percent disapproving. The governor is up for reelection this year. Noem has consistently faced criticism from advocates and stakeholders over her early opposition to cannabis reform.
